Welcome to Equivaleat. These Terms of Service ("Terms") govern your use of the Equivaleat mobile and web application (the "App"). By creating an account or otherwise using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 16 years old, or the age of legal consent in your jurisdiction, to create an account and use the App. By using the App you confirm that you meet this requirement and that you can enter into a legally binding agreement.
The App lets you scan food product barcodes, browse nutrition information, compare products and substitutions, and set personal preferences such as allergies, dietary pattern, and nutrition goals. Nutrition data is provided by third-party databases (including USDA FoodData Central and Open Food Facts) and may be incomplete, inaccurate, or change over time without notice.
The App provides general food and nutrition information for informational purposes only. It is not medical advice, diagnosis, or treatment, and it is not a substitute for the advice of a qualified healthcare professional, dietitian, or nutritionist. Do not make health, dietary, or medical decisions based solely on information in the App. Always consult a qualified professional for personal dietary or health concerns.
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You agree to notify us promptly if you suspect unauthorized access to your account. You may not share your account or credentials with others except as permitted by law.
You agree to use the App only for lawful purposes and in accordance with these Terms. You may not attempt to disrupt, overload, or interfere with the App or its underlying infrastructure, scrape or abuse product data, gain unauthorized access to any part of the service, or use the App in any way that violates applicable law.
Product, ingredient, and nutrition information comes from third parties and is provided "as is". We do not warrant the accuracy, completeness, or currentness of this data. You acknowledge that product labels and regulations can change and that the information shown may not reflect the latest formulation.
The App, including its software, design, brand, text, and graphics, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App personally, for your own benefit, and not for commercial resale.
You may upload a profile picture and provide preferences. You retain ownership of your content, and you grant us a limited license to store and display it as needed to operate the App (for example, showing your selected profile picture and storing your preferences to personalize the App).
Our collection and use of your personal information is described in our Privacy Policy, which forms part of these Terms. Please review it carefully at /legal/privacy.
You may stop using the App and delete your account at any time from the Profile screen, which removes your stored preferences and account data as described in our Privacy Policy. We may suspend or terminate your access if you breach these Terms, misuse the App, or if we reasonably believe continued access would pose a risk to us or others.
To the maximum extent permitted by law, the App and its data are provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise. We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the App or your reliance on its data. You agree that your sole and exclusive remedy with respect to the App is to stop using it and delete your account.
You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the App, your breach of these Terms, or your violation of any law or the rights of a third party.
These Terms are governed by the laws of the jurisdiction in which we are established, without regard to its conflict-of-law principles. If you are a resident of another jurisdiction, you may also have rights under the laws of your own country that cannot be waived by these Terms.
We may update these Terms from time to time. We will post a notice of material changes in the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you may delete your account and stop using the App.
If any provision of these Terms is found unenforceable, that provision will be limited to the minimum extent necessary and the remaining provisions will continue in effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App.
